HIPAA Notice of Privacy Practices
Softwave Regeneration LLC DBA Evolve Wellness MD | Effective March 3, 2024
IMPORTANT NOTICE
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, HOW YOU CAN GET ACCESS TO THIS INFORMATION, AND YOUR RIGHTS AND OUR
RESPONSIBILITIES. PLEASE REVIEW IT CAREFULLY.
Who This Notice Covers
This Notice applies to protected health information maintained by Softwave Regeneration LLC DBA Evolve Wellness MD when acting as a HIPAA covered health care provider, and to workforce members and business associates as applicable. Independent clinicians or organizations may provide their own notice when legally required.
Your Rights
You may ask to inspect or obtain an electronic or paper copy of your designated medical record; ask us to correct information you believe is incorrect or incomplete; request reasonable confidential communications; ask us to limit certain uses or disclosures; request an accounting of certain disclosures made during the prior six years; receive a paper copy of this Notice; appoint a legally authorized personal representative; and complain without retaliation if you believe your privacy rights were violated. We may deny or limit a request when the law permits or requires, and we will explain applicable review rights. We generally act on access requests within 30 days and amendment requests within 60 days, subject to legally permitted extensions. A reasonable, cost-based fee may apply where permitted.
Restrictions for Services Paid in Full
If you pay out of pocket in full for a service or item, you may ask us not to disclose information about that service or item to your health plan for payment or health care operations. We will honor that request unless disclosure is required by law.
Your Choices
You may tell us whether and how to share information with family, friends, or others involved in your care or payment, and for disaster-relief purposes. If you cannot state a preference, we may share relevant information when professional judgment indicates it is in your best interest or when needed to lessen a serious and imminent threat. We generally need your written authorization for marketing, sale of protected health information, and most uses or disclosures of psychotherapy notes. You may revoke an authorization in writing, except to the extent action has already been taken in reliance on it.
Treatment, Payment, and Health Care Operations
We may use and disclose your protected health information to provide, coordinate, or manage treatment; obtain payment; and conduct health care operations such as quality improvement, care coordination, credentialing, auditing, legal and compliance services, business planning, and administration. For example, we may share relevant information with a clinician, laboratory, or pharmacy involved in your care.
Other Uses and Disclosures Permitted or Required by Law
Subject to legal conditions and safeguards, we may use or disclose protected health information for public-health and safety activities; reporting adverse events or product recalls; reporting suspected abuse, neglect, or domestic violence; health oversight; research approved or otherwise permitted by law; organ and tissue donation; coroners, medical examiners, and funeral directors; workers' compensation; certain law-enforcement and government functions; judicial or administrative proceedings; preventing or reducing a serious threat to health or safety; and other uses required by law. We apply the minimum-necessary standard when it is required.
Substance Use Disorder Records
To the extent we maintain substance use disorder patient records protected by 42 CFR Part 2, those records receive the additional protections required by federal law. Such records generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient without the patient's written consent or a qualifying court order and subpoena. Additional rules apply to fundraising communications using Part 2 information.
Other Uses
Uses and disclosures not described in this Notice will be made only with your written authorization unless otherwise permitted or required by law. More protective federal or state privacy laws will be followed when they apply.
Our Responsibilities
We are required by law to maintain the privacy and security of protected health information, provide this Notice, follow the Notice currently in effect, and notify affected individuals following a breach when required. We will not retaliate against anyone for filing a privacy complaint.
Changes to This Notice
We may change this Notice and make the revised Notice effective for information we already hold and information received in the future. The current Notice will be available on our website and upon request.
