1. Acceptance of Terms
These Terms and Conditions govern your access to and use of the website, patient portal, telehealth services, consultations, memberships, laboratory coordination, wellness programs, dietary products, and other services offered by Softwave Regeneration LLC, doing business as Evolve Wellness MD ("Evolve," "we," "us," or "our"). By accessing the website, creating an account, scheduling an appointment, purchasing a product, enrolling in a program, or receiving services, you acknowledge that you have read and agree to these Terms and the policies incorporated into them.
2. Medical Services and Provider Relationship
Medical services are provided only by appropriately licensed clinicians. Administrative, coaching, functional-wellness, educational, or customer-support personnel do not diagnose conditions, prescribe medications, or replace the judgment of a licensed clinician. A clinician-patient relationship is established only when the applicable legal and clinical requirements have been satisfied. Use of the website, completion of an intake form, payment, or scheduling alone does not guarantee that treatment or a prescription will be offered.
3. Individualized Medical Plan
Any medical plan is individualized using information such as health history, symptoms, medications, allergies, laboratory results, examination or telehealth findings, treatment goals, and the clinician's independent judgment. A clinician may require additional records, laboratory testing, an in-person evaluation, referral, or follow-up before starting or continuing treatment. Treatment, dosage, refills, and continuation are never guaranteed. A clinician may modify, pause, decline, or discontinue a plan when medically appropriate or legally required. Patients must provide complete and accurate information, report adverse effects or material health changes promptly, complete required monitoring, and follow clinical instructions.
4. Telehealth
Telehealth may involve video, telephone, electronic messaging, questionnaires, remote monitoring, or other permitted technologies. Telehealth has benefits and limitations, including possible technology failures and limits on what can be evaluated remotely. Services are available only where Evolve and the treating clinician are authorized to practice, and the patient must be physically located in an eligible jurisdiction at the time of care. Telehealth is not appropriate for every condition. The clinician may require in-person care.
5. Emergencies
Evolve is not an emergency service and the website and portal are not monitored for emergencies. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not use portal messages, email, or website forms for urgent or emergency needs.

6. Prescriptions, Compounded Products, and Dietary Products
All prescriptions are subject to a licensed clinician's independent medical judgment and applicable law. Prescriptions may be filled by third-party pharmacies, which are responsible for compounding or dispensing, labeling, shipping, and pharmacy-specific counseling. Compounded medications are not reviewed or approved by the U.S. Food and Drug Administration in the same manner as FDA- approved medications. Dietary products are not intended to diagnose, treat, cure, or prevent disease unless expressly authorized by law. Follow storage, dosing, expiration, and disposal instructions. Never share prescription medication.
7. Laboratory Services
Laboratory services may be performed by independent laboratories. Fees, specimen requirements, processing times, and results may depend on the laboratory. Abnormal or urgent results may require additional evaluation, and patients remain responsible for seeking emergency care when appropriate.
8. Payments and Medical Plans
Evolve operates on a self-pay basis and accepts credit cards and cash payments. Fees may cover different components, including administrative services, clinical consultations, laboratory coordination, medication or product costs, shipping, and ongoing monitoring. Program fees are not health insurance. Patients are responsible for understanding the charges presented before purchase and for any outside care, laboratory, pharmacy, or emergency costs not expressly included. Recurring plans continue according to the enrollment terms until cancelled in the manner stated at enrollment. Charges already incurred for completed consultations, ordered laboratory work, processed prescriptions, shipped products, or services already provided remain due. LegitScript Certification. Softwave Regeneration LLC DBA Evolve Wellness MD is LegitScript Healthcare Merchant Certified. According to LegitScript, this certification provides independent verification that a business meets LegitScript's Healthcare Merchant Certification Standards and may support eligibility for participating advertising and payment-processing opportunities, subject to each platform's separate policies and approval. Certification does not guarantee advertising approval and does not guarantee any particular medical treatment, prescription, or patient outcome.
9. No Guarantee of Results
Health and weight-management outcomes vary. Evolve and its clinicians do not promise a specific diagnosis, treatment, prescription, weight change, symptom response, laboratory result, or other outcome.
10. Patient Account and Communications
You are responsible for safeguarding your login information and promptly notifying Evolve of suspected unauthorized access. You consent to receive service-related communications using the contact information you provide. Standard email and text messaging may carry privacy risks. 11. Website Content
Website and educational content is general information and is not a substitute for individualized medical advice. Do not delay seeking professional care because of website content. Unless otherwise stated, Evolve owns or licenses the website content, brand materials, and associated intellectual property. Content may not be copied or commercially reused without permission.
12. Third-Party Services
Evolve may use independent clinicians, laboratories, pharmacies, technology platforms, payment processors, and delivery services. Those parties may have separate terms and privacy practices. To the extent permitted by law, Evolve is not responsible for matters controlled exclusively by an independent third party.
13. Disclaimer and Limitation
Services are provided subject to applicable professional standards and consumer-protection laws. To the fullest extent permitted by law, website access and non-medical content are provided without warranties not expressly stated here. Nothing in these Terms waives a patient's rights, limits professional duties, or excludes liability that cannot legally be limited.
14. Changes and Governing Law
We may update these Terms prospectively by posting a revised version and effective date. Material changes will be communicated when required. These Terms are governed by applicable federal law and, where legally permitted, the laws of the State of Georgia, without overriding mandatory laws of the state where a patient receives care.
